Terms and Conditions

This Service Agreement (hereinafter referred to as the "Agreement") is a binding and valid agreement between PT Solusi Teknologi Niaga, a company established and subject to the laws of the Republic of Indonesia ("Qasir" or "We") and You, referring to business operators, including their affiliates in the form of individuals, legal entities, and/or other business entities ("You" or "User") who use the Services (as defined below) and agree to be bound by the terms and conditions of this Agreement.

We have a website at: https://www.qasir.id/ and an online-based trading system application with a Point of Sales (POS) model ("Application") under the brand name "Qasir", which functions to facilitate business operators in running their businesses by recording sales results, monitoring stock, and more (hereinafter referred to as "Services").

By downloading, installing, and/or using the Services, You hereby declare Your agreement to all terms and conditions set out in this Agreement. You declare that You have read, understood, accepted and agreed to all the contents of this Agreement, which constitutes a civil agreement. If You do not agree to the contents of this Agreement, please stop using the Services.

Consent to this Agreement also includes Your consent to any additions, modifications, and all changes to the contents of the terms and conditions of this Agreement, including any other terms and conditions found in additional services, applicable as long as You access and use such additional Services ("Other Additional Agreements"). The terms and conditions contained in Other Additional Agreements are an integral and inseparable part of this Agreement. However, the provisions in Other Additional Agreements may be determined differently as long as expressly stated therein. Therefore, We recommend that You always read periodically the contents of this Agreement and Other Additional Agreements, if any.

WE RECOMMEND YOU TO CAREFULLY REVIEW ALL THE CONTENTS OF THE AGREEMENT'S TERMS AND CONDITIONS BEFORE USING THE SERVICES.

1. CONSENT

1.1. Our Consent

We grant You a usage consent to use the Services subject to the terms and conditions of this Agreement and/or Other Additional Agreements. This usage consent is granted to You on a non-exclusive (Non-Exclusive), non-transferable (Non-Transferable) basis, and is solely intended for You in accordance with Your use for the smooth running of Your business or as the purpose of these Services.

1.2. Your Consent

You declare to Us that You give Your consent to use the Services without coercion from any party, and You have the legal capacity to agree to this Agreement.

2. SERVICES

2.1. Free Version Services

We provide You with Services that You can use for free for 7 days. The use of the free version of the Services allows You to enjoy all Qasir features for 7 days. We make no warranty representations to You regarding Your use of the free version of the Services, other than the features contained therein on an as-is basis. However, We will lock Your account if the free feature usage period has exceeded the time limit.

2.2. Paid Version Services

We provide You with various paid version Services that You can purchase according to Your business needs, including:

• Qasir Pro and Pro Plus — These are paid Services provided to You to access complete features during the subscription period. More information can be found at https://www.qasir.id/qasir-pro
• Additional Features and/or Other Paid Services — These are paid Services provided to You for specific features. You can purchase Additional Features available on the Services.

The paid Services above may change at any time with reasonable prior notice to You.

We may also from time to time provide and offer other paid Services to You. Subject to the Agreement and/or Other Additional Agreements, You may only access the features, modules, and functions contained in the paid version of the Services if You have successfully made payment to Us.

3. FEES AND PAYMENT

You will not be charged and required to make payment to Us when You download and use the free version of the Services. The charging of fees and obligation to make payment to Us is subject to the terms and conditions and Your choice to use the paid version of the Services.

You will make payment of a certain amount through the payment mechanism We have provided in the order form or invoice (invoice) or valid order form. Unless otherwise determined, access to paid Services, including their features and modules, will end when the subscription period expires or has been used according to the set quota.

We reserve the right to determine and charge certain fees and payment mechanisms from time to time for Your use of the paid version of the Services. These provisions will be subject to the terms and conditions of applicable laws and regulations, such as regulations on taxes, currency, national or international trade, and other applicable regulations.

4. LIMITATIONS

We strive to provide You with Services accessible 24 (twenty-four) hours a day. However, We cannot guarantee that the Services will always be available at all times without interruption. If You encounter any errors (bugs) while using the Application, You may notify Us and request repairs. We will carry out routine maintenance on the Services from time to time.

We do not guarantee that the Services We provide will be suitable for Your business purposes in all conditions and situations. We will continue to strive to maintain the quality of the Services to remain safe, comfortable, and functioning well.

To the extent permitted by applicable law, We (including affiliated companies, directors, commissioners, officers, and all employees and agents) are not responsible for losses arising from the use or inability to use Our Services.

5. AGREEMENT TERM

This Agreement will remain in effect as long as You continuously use our Services. However, We may terminate the terms and conditions of this Agreement if:

1. You violate the terms and conditions of this Agreement and it cannot be remedied;
2. You have intentionally violated the intellectual property rights of third parties;
3. Your use of the Services is carried out in an unlawful or unauthorized manner; and/or
4. You are in the process of applying for bankruptcy and a court ruling, whether filed by You or by a third party.

6. DATA MANAGEMENT AND PRIVACY POLICY

By accessing and/or using the Services, You agree to share data, including Your personal data with Us. You hereby agree to the terms and conditions of the data sharing policy during the use of the Services as set forth in the Privacy Policy.

We recommend that You read and understand the Privacy Policy so that You know how We collect, use, and share Your data.

7. INTELLECTUAL PROPERTY RIGHTS

The Services and applications provided to You, including but not limited to names, logos, trademarks, trade secrets, user interfaces, designs, texts, images, videos, source code, databases, and technology are Our property, copyright, confidential information, and/or intellectual property rights (hereinafter referred to as "IPR"). You are not permitted to copy them unlawfully and/or use them illegally without written permission from Us.

The provisions of this Agreement expressly state that You are prohibited from reverse assembling (reverse assemble), reverse compiling (reverse compile), and/or reverse engineering (reverse engineering) the Application and/or Services in part or in whole.

8. THIRD PARTY SERVICES

The Services We provide to You may also include Services from third parties in accordance with Our business cooperation with such third parties. You agree that the use of third-party services will be subject to the terms and conditions of those third-party services. Therefore, to the extent permitted by applicable law, We (including affiliated companies, directors, commissioners, officers, and all employees and agents) are not responsible, and You agree not to hold Us responsible for any damage or loss caused by the failure of such third-party services.

9. CHOICE OF LAW AND DISPUTE RESOLUTION

This Agreement is governed by and interpreted in accordance with the laws of the Republic of Indonesia, without regard to conflict of law rules. You agree that any legal action or dispute that may arise from, be related to, or be in any way connected with the Services and/or these terms and conditions will be resolved exclusively through BANI (Indonesian National Arbitration Board).

10. CHANGES

We have the right to update and/or change the provisions of this Agreement from time to time as needed. Any changes to the provisions of the Agreement will be announced to You through the Services or other media. By continuing to use the Services after such changes, You are deemed to have agreed to those changes.
